其次,/需要以没收的财产偿还0,是指/需要以已经没收的财产偿还0还是指/需要以拟没收的财产偿还0?显然,二者的程序不同。如果是前者,那么,债权人应当向国家机关请求,由国家机关偿还。如果是后者,则意味着债权人仍然只能是向被告人请求,由被告人偿还。但是,一方面,在人民法院还没有判决没收财产时,怎么可能有拟没收的财产呢?显然,只有当法院已经判处了没收财产后,才存在/需要以没收的财产偿还0的问题。另一方面,如果在判决没收财产之前,由被告人与债权人自行处理债权债务关系,必然导致被告人转移财产,不利于没收财产刑的执行。所以,本文认为,应当在人民法院做出没收财产的判决后,判决执行前,经债权人请求,返还给债权人。在这种场合,人民法院应当审查债务的正当性,由于没收财产还没有执行,故偿还的主体依然是被告人,而不是国家机关。

最后,需要以没收的财产偿还,是仅限于没收全部财产的情形,还是包括没收部分财产的情形?换言之,在人民法院判处没收部分财产时,是否存在需要以没收的财产偿还正当债务的问题?本文持肯定回答。否则,不利于保护第三者的合法权益。例如,被告人有一套住宅和若干现金,法院判处没收全部现金,而没有判处没收住宅。在这种情况下,即使住宅的价值多于全部现金,但是,让被告人变更住宅后偿还第三者的正当债务并不现实。在这种情况下,应当认为以没收的部分财产偿还正当债务,即适用刑法第60条的规定。
