第二，重新界定行政权与司法权的关系。

根据我国现行的国家机关体系，虽然司法机关独立于行政机关或行政主体，但是，行政机关或行政主体仍然具有干预司法机关依法行使职权的可能性。因此，司法机关对于行政主体滥用行政自由裁量权的行为不可能进行完全有效的监督与控制。我国应该逐步建立相应制度，真正确立司法机关的独立地位，维护司法机关的权威。

第三，适当建立行政判例制度。

我国虽然是成文法国家，但是，不可否认，随着最高人民法院司法解释制度的发展，我国已经间接承认了判例制度。因为法国与我国都是成文法国家，而法国的行政法律制度中存在着大量的判例法，我国可以借鉴法国的经验，用行政判例的方式解决具体的行政案件，这也顺应了WTO规则要求法制统一的趋势。
