1. 试析保险受益权之保护与限制

摘 要:

保险合同中，受益人的保险金给付请求权属于固有权并非继受而来。保险事故发生后，受益人取得的保险金不得作为被保险人的遗产，不能用以清偿被保险人生前的债务，保险人受益权方能得到很好的保护。我们在充分保护受益人的同时也不能忽视：寿险合同具有储蓄性，倘若投保人为逃避债务，将自己的财产借寿险机制转赠于受益人，从而导致失去清偿债务的能力。则法律如何保护投保人的债权人的利益呢？笔者认为，我国的法律应该引入相应的规制机制，以保障被保险人的遗属获得足够的经济保障，同时兼顾投保人的债权人的利益，防止投保人利用寿险机制转移财产，逃避债务的清偿。[著者文摘]

We should notice too while fully protecting the beneficiary： The contract of insurance of life insurance has depositting money nature. If insure and escape debts artificially but take advantage of one＇s own property life insurance to represent to the beneficiary and thus result in losing ability to clear up the debt, then how does the law protect the interests of the insured＇s creditor？ I think The law of our country should introduce the corresponding mechanism in order to ensure the assured＇s relatives to obtain enough economic guarantee. Prevent the insured from utilizing the mechanism of the life insurance to shift the property, escape the liquidation of the debt.[著者文摘]
